The Lotus Case
France V. Turkey (1927)

On August 2nd, 1926, the French steamer, Lotus,collided on the high seas with
the Turkish steamer Boz-kourt, due allegedly to the grass negligence of the
watch on board the Lotus, with the result of loss of the Boz-kourt having i
nvolved the death of eight Turkish sailors and passengers. Upon the arrivin
g of the French steamer at Constantinpole, the Turkish authorities instituted
proceedings against the officer of the watch, basing the claim to jurisdicti
on on the ground that the act of negligence on board the Lotus has produced e
ffects on the Boz-kourt, and thus according to the rule of internatinal law,
on a portion of Turkish territory.
